Lunaire Works is a trading name exclusively owned and operated by STERZEAL HATS LIMITED, a company incorporated and registered in England and Wales (Company Registration Number: 13249070). The Lunaire Works name, its visual presentation, and all associated brand assets are the exclusive commercial identity of STERZEAL HATS LIMITED.

The "Lunaire Works" name — including all stylisations, abbreviations, and phonetic variants of it — is used in trade in connection with the design, manufacture, and sale of decorative interior wall panelling, MDF wall panel kits, tongue and groove panelling, Shaker-style wall panels, Cheshire moulding dado kits, moisture-resistant MDF boards, pine dado rails, and related accessories and fixings supplied to customers throughout the United Kingdom.

Under the Trade Marks Act 1994, unregistered trade marks used in the course of trade are protected against passing off under UK common law. Any unauthorised use of the name "Lunaire Works", its stylised presentation, or any confusingly similar name in connection with competing goods or services constitutes passing off and may additionally constitute trade mark infringement if the mark is registered.

What Our Product Images Are

Product photographs published on this website — including images of Shaker wall panel kits, tongue and groove panelling, Cheshire moulding dado kits, MR MDF moisture-resistant boards, pine dado rails, and accessories — are original artistic works protected under section 4(1)(a) of the Copyright, Designs and Patents Act 1988 as photographs. Copyright in each photograph subsists automatically from the moment of creation and vests in the photographer or, where the photograph was taken in the course of employment or under a commission arrangement with STERZEAL HATS LIMITED, in STERZEAL HATS LIMITED as the commissioning company.

The lifestyle and before-and-after installation images published on this website — including the room-set photography showing Lunaire Works panels installed and painted — are commissioned works and the copyright in those images is owned by or exclusively licensed to STERZEAL HATS LIMITED. These images may not be reproduced, cropped, filtered, edited, or re-published by any third party without our express written consent.

Restriction on Scraping & Automated Collection

The automated extraction, scraping, crawling, or harvesting of product images, product descriptions, pricing data, or any other content from lunaireworks.com — by bot, script, web crawler, or any other automated means — is expressly prohibited. This includes but is not limited to:

  • Scraping product images for use on a competing or copycat website
  • Harvesting product descriptions to populate a rival product catalogue
  • Systematically collecting pricing data for commercial price-intelligence purposes without our consent
  • Downloading and storing product images in a dataset for AI model training without our written consent

Unauthorised scraping of this website constitutes both copyright infringement under the CDPA 1988 and a breach of the Computer Misuse Act 1990 where automated access exceeds authorised access.

Resellers & stockists: Authorised resellers who hold a current written reseller agreement with STERZEAL HATS LIMITED are granted a limited, non-exclusive, non-transferable licence to use Lunaire Works product photographs and product descriptions solely for the purpose of listing and selling Lunaire Works products to end customers, subject to the terms of that agreement. Design Rights in Our Products

Protection of the original panel profiles, moulding shapes, and kit layouts that define Lunaire Works products under UK design law.

UK Unregistered Design Right (UDR)

Under sections 213 to 225 of the Copyright, Designs and Patents Act 1988, original aspects of the shape and configuration of our products — including the specific dimensional profiles of our MDF wall panels, the groove geometry of our tongue and groove range, the moulding cross-sections used in our Cheshire dado kits, and the panel spacing layouts included in our Shaker kit configurations — are protected as unregistered design rights where those features are original and not commonplace in the UK wall panelling industry.

UK unregistered design right arises automatically from the date of creation and lasts for 10 years from the date the design is first made commercially available, or 15 years from the date of creation — whichever expires first. During the first five years of the protection period, the design right owner may prevent copying of the design. In the last five years, a licence of right is available (meaning a third party may apply for a licence to use the design, but must still pay a reasonable royalty).

Any manufacturer, competitor, or individual who copies the specific shape or configuration of a Lunaire Works product without our consent may be infringing our unregistered design right and may be liable for damages or an account of profits under the CDPA 1988.

What "Copying" Means in This Context

For the purposes of design right infringement, "copying" a Lunaire Works product means producing an article to a design that reproduces the design — or a design not substantially different from it — by reference to the original. It is not copying to independently arrive at a similar design without reference to ours.

Purchasing a product does not transfer any copyright or design right in the underlying Lunaire Works intellectual property — it transfers ownership of the physical item only.

Digital & Online Misuse Prohibitions

  • Prohibited Creating a website, marketplace listing, or online profile that is designed to impersonate, mimic, or trade off the name or reputation of Lunaire Works.
  • Prohibited Systematically scraping, harvesting, or extracting content from this website by automated means, including using our product data to train AI or machine learning models.

What we will do with your report

We take all infringement reports seriously. Upon receiving a complete report, we will:

  • Acknowledge receipt of your report within 3 business days
  • Investigate the alleged infringement and, where necessary, take legal advice
  • Where infringement is confirmed, issue a written notice to the infringing party requiring them to cease the infringing activity and, where appropriate, remove or destroy infringing copies
  • Where infringing content is on a third-party platform (e.g. Amazon, eBay, Etsy), we will issue a takedown notice to that platform under applicable intellectual property enforcement procedures
  • Where infringement is serious, repeated, or commercially significant, we reserve the right to commence proceedings in the courts of England and Wales without prior notice, seeking injunctive relief, damages, and/or an account of profits
False or malicious reports: Knowingly submitting a false infringement report may expose you to civil liability for the losses caused to the person you have falsely accused. Please only submit reports where you have a genuine, good-faith belief that infringement has occurred.

Cease and Desist

In the first instance, where we identify or are made aware of infringement, we will typically issue a formal cease and desist letter to the infringing party, requiring them to immediately stop the infringing activity, remove infringing copies or listings, and provide a written undertaking not to repeat the infringement. Failure to comply with a cease and desist letter may result in immediate legal proceedings without further notice.

Court Proceedings & Injunctions

Under the CDPA 1988, Trade Marks Act 1994, and UK common law, STERZEAL HATS LIMITED may apply to the courts of England and Wales for: an injunction to stop the infringing activity (including on an urgent interim basis before a full trial); delivery up or destruction of infringing copies or goods; and damages to compensate us for the financial loss caused by the infringement, including lost sales, loss of reputation, and costs of investigation.

Account of Profits & Additional Damages

Instead of damages, we may elect to seek an account of profits — that is, all profits the infringing party made from their infringement. Under section 97(2) of the CDPA 1988, a court may award additional damages in cases of flagrant infringement (such as deliberate copying of our product photographs for commercial gain), which can significantly increase the total sum awarded above standard compensatory damages.
